General Warranty Conditions

As part of its exclusive support package, CAYAGO AG (Seller), Benzstrasse 10, D-32108 Bad Salzuflen, guarantees the buyer of a SEABOB jet that the vehicle will be free from defects in materials and workmanship during the coverage period specified below. CAYAGO AG will indemnify the end customer from the costs of remedying a material or workmanship defect in accordance with your warranty conditions as part of the exclusive support package.

The warranty is 2 years and starts on the date of transfer.

Warranty and liability

• If the delivered item is defective or lacks guaranteed properties or if it becomes defective within the warranty period due to manufacturing or material defects, the seller shall deliver a replacement or repair at its discretion to the exclusion of other warranty claims of the buyer.
• The buyer must carefully inspect the delivered item upon acceptance or immediately thereafter. Obvious defects must be reported to the seller immediately. The defective delivered item must be kept ready for inspection by the seller in the condition in which it was at the time the defect was discovered. A breach of the above obligations excludes any warranty claims against the seller.
• The warranty claim expires six months after the discovery of the defect.
• Costs incurred in connection with warranty work for transportation of the purchased object to and from the site shall be borne by the buyer. The operating instructions, general information and safety instructions that are handed out are part of the purchase contract. Repair or replacement will not extend or renew the warranty.
• If the repair or replacement delivery fails after a reasonable period of time, the buyer can demand damages instead of performance or reduction of the purchase price.
• Claims for damages arising from impossibility of performance due to non-performance, from positive breach of contract, from fault at the conclusion of the contract and from tort are excluded against the seller as well as against his vicarious agents or vicarious agents, unless the damage was caused intentionally or by gross negligence. No liability is assumed for consequential damages.

CAYAGO AG does not grant guarantee if the defect is due to:

• natural wear and tear,
• damage not caused by the seller, a legal representative or a vicarious agent of the seller due to improper handling, in particular also storage,
• a special type of use that contradicts the normal use of the object of purchase, which the seller has not agreed to in the individual case,
• repair, maintenance and care in a company not recognised by the seller for support,
• the installation of parts the use of which has not been agreed to by the seller,
• changes to the object of purchase in a manner not authorized by the seller,
• non-compliance with the regulations and operating instructions for the treatment, maintenance and care of the purchased item.

Excluded from the warranty are vehicles that are used – even temporarily – for commercial or official purposes. The statutory warranty applies to these.

In addition to the claims arising from this warranty, the end customer has statutory warranty claims from his purchase contract with the respective dealer, which are not limited by this warranty.
